Terms of Service

These Terms of Service are an agreement between you and Obsidian Code LLC, a Virginia limited liability company doing business as "Whet" ("Whet," "we," "us"). By accessing or using whet.gg or the Whet app for iPhone or Android (together, "the Service"), you agree to be bound by these terms. If you do not agree, do not use the Service.

These Terms, together with our Privacy Policy and Responsible Gambling page, are the complete agreement between you and Whet; the latter two are incorporated into these Terms by reference.

Whet is a sports betting analytics platform. We provide odds comparison, expected value calculations, and statistical projections. Whet does not accept or place wagers: a sportsbook link opens that sportsbook's own site or app, and any bet you place there is between you and the sportsbook. We are an information and analytics tool only.

Whet is not a sportsbook, bookmaker, casino, or betting agent. We never handle your wagers, your winnings, or your bankroll, and nothing on Whet is betting, financial, or legal advice.

You must be at least 21 years old to use Whet. By using the Service, you represent and warrant that you meet this requirement.

Sports betting is not legal everywhere. You are responsible for knowing whether betting, and using betting-analytics tools, is legal where you live.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access. You may not share your account or use another person's account.

Where you buy decides who bills you. On whet.gg, Stripe bills a monthly or yearly plan, and you authorize us to charge your payment method each billing period. In the Whet app, Apple bills you through your Apple ID on an iPhone, and Google Play bills you through your Google account on an Android phone. The price, any free trial and the billing period are shown before you buy. Apple's or Google Play's own terms also apply to those payments.

Renewing and cancelling. Every plan renews automatically at the end of each period until you cancel it. On whet.gg, cancel on the Billing page. On an iPhone, open Settings, tap your name, then Subscriptions. On Android, open the Play Store, tap your profile picture, then Payments & subscriptions, then Subscriptions. In the app, the Manage subscription button on the Membership screen opens Apple's or Google Play's own page. For a membership bought in the app, cancel at least 24 hours before the free trial or the current period ends to stop the next charge. After you cancel, you keep the full board until the end of the period you paid for, or of your free trial.

Free trials. On whet.gg, a first membership starts with a 7-day free trial, or 14 days if you joined through a member's referral link. You add a card at checkout and aren't charged until the trial ends. An account gets a whet.gg trial only if it has never had a trial or a membership before, on whet.gg or in the app. In the app, Apple or Google Play gives a free trial where the store offers one and says you can have it, and the purchase screen shows it before you buy. If you don't cancel before a trial ends, you're charged the price shown for the first period.

Founder price. The founder price is $14.99 a month on whet.gg, for the first 100 members who take it. It is monthly only, and it stays at $14.99 while your membership stays active. Founders can't switch plans themselves: any change to a founder plan goes through support@whet.gg. Cancelling gives it up, and it may not be available again. Once Whet has 1,000 or more paying members on every daily count for 7 days in a row, every founder whose membership is still active becomes free for life, automatically: we stop charging you, and you keep the full board for as long as Whet runs the Service. Paying members here means active paid memberships on whet.gg, the App Store and Google Play together, each member counted once, not counting free trials, comped plans or founders themselves.

Refunds. On whet.gg, charges are non-refundable, and we don't give partial refunds when you cancel mid-period, except as this section says. As a courtesy, if you email support@whet.gg within 24 hours of a whet.gg charge, we may refund it in full. Whet can't refund an App Store purchase: Apple decides every refund for a purchase made on an iPhone. To ask Apple, tap Request a refund on the app's Membership screen, or go to reportaproblem.apple.com. For a purchase made on Android, you can ask Google Play for a refund within 48 hours of the charge, or email support@whet.gg within 24 hours of it and we may refund it in full, as on whet.gg. If Apple or Google Play refunds a purchase, the membership it paid for ends.

Billed in two places. The app never offers a purchase to a member someone already bills, and if a second bill starts anyway, this is what we do. If a store starts billing you while a whet.gg plan is running, we cancel the whet.gg plan right away and refund the unused days of what you paid for it; a whet.gg free trial just ends, with nothing charged, and an unpaid whet.gg bill is cancelled. If a whet.gg checkout goes through while a store already bills you, we cancel it and refund it in full. If you buy on Google Play while a store already bills you, we cancel that purchase and refund it in full. If you buy in the App Store while Google Play bills you, we keep the Apple membership, cancel the Google Play one and refund its unused days (a Google Play free trial just ends). If a second Apple ID buys Whet while Apple already bills you, that purchase isn't added and only Apple can refund it: tap Request a refund on the Membership screen to ask Apple, and cancel it in that Apple ID's settings.

Failed payments. If a whet.gg payment fails, Stripe retries it and you keep the full board while it does. If the payment still doesn't go through, your account moves to the free plan. If an App Store or Google Play renewal fails, the store retries it under its own rules, and you keep the full board during any grace period the store gives. On an iPhone, that grace period is up to 16 days when a paid period renews, and there is none when a free trial's first charge fails. After a grace period ends, your account is on the free plan while the store keeps trying, and the full board comes back if the payment goes through.

How Whet makes money: Whet is funded by paid subscriptions. We do not currently earn affiliate commissions, referral fees, or revenue sharing from any sportsbook. Links to sportsbooks are provided only as a convenience to help you find the best available line. If this ever changes, we will disclose any such relationship clearly.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or redistribute our data
• Share account access with unauthorized third parties
• Interfere with or disrupt the Service or its infrastructure
• Circumvent rate limits or access controls

All content, algorithms, data models, and visual designs on Whet are our intellectual property. You may not copy, modify, or distribute any part of the Service without written permission.

As long as you follow these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

If you got the Whet app from Apple's App Store, Apple's standard license for apps (its Licensed Application End User License Agreement) also applies to your use of the app.

Whet has no public feed. Notes you attach to your own bets are private to your account, and nothing you enter is shown to other users. If we add a place to post publicly, you will own what you post, and by posting you would give us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the Service. You would not be allowed to post anything unlawful, infringing, abusive, or misleading, including anything that promotes underage or illegal gambling, and we could remove content or suspend accounts that break those rules.

Copyright complaints (DMCA): if you believe content on Whet infringes your copyright, email our designated agent at support@whet.gg with (1) the work you say is infringed, (2) the URL of the material, (3) your contact information, (4) a good-faith statement that the use isn't authorized, and (5) a statement, under penalty of perjury, that your notice is accurate and you're authorized to act. We respond to valid notices, including removing content and closing the accounts of repeat infringers.

Designated agent & counter-notice: send copyright notices to our designated agent (Copyright Agent, Obsidian Code LLC) at support@whet.gg. If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address that includes your contact information, identifies the removed material and where it appeared, and states, under penalty of perjury, that you have a good-faith belief the material was removed by mistake. Unless the original complainant files a court action, we may restore the material in 10–14 business days.

Whet is provided "as is" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of any data or projections. Past performance does not guarantee future results. All betting decisions are your own responsibility.

To the maximum extent permitted by law, Whet and its operators shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, or gambling losses, arising from your use of the Service.

Our total liability for all claims, combined, is capped at the greater of (a) the amount you paid for Whet, on whet.gg or to Apple or Google Play, in the 12 months before the event giving rise to the claim, or (b) $100. Some places don't allow certain limits; where that's the case, our liability is limited to the smallest amount the law allows.

If your content, your use of the Service, or your violation of these terms causes a third party to bring a claim against us, you agree to cover the resulting costs and damages, including reasonable legal fees.

We may suspend or terminate your account immediately for fraud, illegal activity, abuse, non-payment, or where required by law. For other material violations of these terms, we will give you notice and a reasonable opportunity to cure (for example, 14 days) before terminating. Upon termination, your right to use the Service ceases. You may delete your account at any time in Settings, or by emailing support@whet.gg. Closing a Whet account, whether you do it or we do, doesn't cancel a membership billed by Apple or Google Play: cancel it in your Apple ID or Google Play settings, or it keeps renewing.

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be communicated via email.

Please read: this section affects your legal rights. You and Whet agree to resolve disputes through binding individual arbitration and to waive class actions and jury trials. You may opt out of arbitration within 30 days (see below).

Most issues can be solved with an email. Before anything formal, contact us at support@whet.gg and we'll try to work it out within 60 days.

If we can't, you and Whet agree to resolve any dispute through binding individual arbitration instead of in court, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration will happen in your county, by video, or by phone. Your choice. AAA's rules cap your filing fees; we pay the rest as those rules require. The arbitrator can award the same individual relief a court could.

What this doesn't cover: either of us can still bring an individual claim in small-claims court, and either of us can ask a court to stop unauthorized use or abuse of the Service or our intellectual property.

Your right to opt out: you can reject this arbitration section, no penalty, by emailing support@whet.gg within 30 days of first accepting these terms, with your account email and a statement that you opt out of arbitration. Opting out doesn't affect any other part of these terms.

If 25 or more similar claims are filed by the same or coordinated counsel, the AAA's mass-arbitration procedures apply and claims may be batched.

You and Whet agree that disputes can only be brought individually, not as a plaintiff or class member in any class, consolidated, or representative action, and not as a private attorney general. The arbitrator can't combine your claim with anyone else's or preside over any form of group proceeding. If a court finds this waiver unenforceable for a particular claim, that claim (and only that claim) goes to court. The rest stay in arbitration. To the extent a dispute does end up in court, you and we each waive the right to a jury trial.

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules. Subject to the arbitration section above, any dispute not subject to arbitration must be brought in the state or federal courts located in Virginia, and you consent to their jurisdiction.

If part of these terms is found unenforceable, the rest still applies. These terms are the entire agreement between you and us about the Service. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets. We're not responsible for delays or failures caused by events outside our reasonable control. Sections that should naturally survive termination (like intellectual property, disclaimers, liability limits, and dispute resolution) survive.
